Simplified Probate By State

There are two basic methods that states offer to avoid probate. Some states offer only one of these methods; but most offer both:
(1) Affidavit. In this method you sign a document which says you are owed a certain amount. You have this document witnesses in some fashion, (according to your states’ law) and you must submit it to either an executor, an institution or a county clerk (according to your states’ law). There is a waiting period before the funds or assets will be disbursed. This method is only valid if the estate is under a certain amount, which varies state to state.
(2) Simplified Procedures for Small estates. In this method the executor must put in a request to the appropriate probate court. The court may agree based on the size of the estate, who the heirs are or if the heirs get along amicably.
